Terms of service
These terms govern your use of HexForm, a form-submission service operated by Bright Flair Ltd. By creating an account or using the service, you agree to these terms.
1. The service
HexForm provides endpoints that receive, store, filter, and forward data submitted through forms you configure on your own website. Features, usage limits, retention periods, and availability may vary by subscription plan.
Your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis.
2. Your account
You must provide accurate account information and keep access to your account secure. You are responsible for activity performed through your account and should tell us promptly if you believe it has been compromised.
3. Your forms and submission data
You decide what information your forms request and why it is collected. You are responsible for your forms, their content, and the submission data sent to HexForm, including providing any notices and obtaining any permissions required by law.
You retain ownership of your submission data. You give us permission to process it only as needed to operate, secure, maintain, and improve the service, and to follow your configured storage and forwarding instructions.
4. Acceptable use
You must not use HexForm to:
- break the law, infringe another person’s rights, or facilitate fraud or abuse;
- collect information without an appropriate lawful basis or required notice;
- send malware, probe security, disrupt the service, or bypass usage limits;
- collect passwords, payment-card details, special-category data, or other highly sensitive information unless we have expressly agreed that use in writing; or
- submit unsolicited bulk messages or use the service primarily to distribute junk content.
If your account exceeds 500 MiB / month, or significantly exceeds the average bandwidth usage (as determined by the service), we reserve the right to throttle your hosting until you can reduce your bandwidth consumption. We will always contact you openly if any issues like this are noticed.
5. Subscriptions and payment
Paid plans are billed at the price and interval shown when you subscribe. Payments are managed through Stripe. You may change or cancel your plan through your account; changes take effect as described during checkout or in the billing portal. Fees already incurred are non-refundable except where the law requires otherwise.
6. Availability and changes
We aim to provide a reliable service, but do not promise that it will always be uninterrupted or error-free. We may change, suspend, or discontinue features where reasonably necessary. If a change materially reduces a paid service, we will aim to give reasonable notice.
7. Suspension and termination
You may stop using HexForm at any time. We may restrict or terminate access if you materially breach these terms, create security or legal risk, fail to pay applicable fees, or use the service in a way that could harm HexForm or others. Where practical, we will give notice and an opportunity to resolve the issue.
8. Liability
Nothing in these terms excludes liability that cannot legally be excluded. To the fullest extent permitted by law, HexForm is not liable for indirect or consequential loss, loss of profit, or loss caused by content submitted to your forms, third-party services, or your configuration of the service.
For paid service, our total liability arising from HexForm during any 12-month period is limited to the amount you paid for the service during that period. To the fullest extent permitted by law, we accept no liability arising from the use or unavailability of any service provided free of charge.
9. Changes to these terms
We may update these terms to reflect changes to the service, law, or our business. We will publish the revised terms here and update the date above. We will provide reasonable notice of material changes where appropriate.
10. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, subject to any mandatory rights you have under the law where you live.
